 ‘Take Action: for both affected homeowners and family & friends who want to help

CIL Guidance notes to Councils para 049 states:

“People who extend their homes or build residential annexes ARE exempt from the levy providing they meet certain criteria “ 

· Engage with your Council

  1. Start with your local elected Councillors, there is usually more than one and request a meeting  

 – you need to find someone who will champion your cause  from within the Council and ask them to “fight for your injustice to be  corrected” 

·   2. Request a meeting with the Leader of your Council and the Council CEO. The Leader is one person who has the power to correct this – if there is the “political will” 

·       Ask public questions at the Full Council meetings and Exec Committee meetings to raise awareness and engagement and also consider writing to the Chair of the O+S (Overview and Scrutiny) Committee.

· Engage with your MP,

  1. Request a meeting at their local surgery for them to hear first-hand your experiences
  2. Highlight that The Minister has stated (July 15th 2025)

  “CIL was never intended to be use this way “ 

“Naming West Berks as a good example of a Council that has used discretion and refunded homeowners “

3. Ask them to write to the Minister of Housing, Communities and Local Government (MHCLG), to highlight your case and seek urgent guidance for councils to adopt discretionary approaches that would repay CIL for homeowners have never by  withdrawing the liability notice and  – repaying homeowners charges if already paid

4. Ask your MP to write to your Council on your behalf to support retrospective refunds for homeowners affected in the past and to update their policies to include discretion

In all situations present your case, including evidence of flexibility in other councils and request that a discretionary approach or refund is adopted in line with West Berkshire where: 

“had the homeowner submitted the correct forms on time and would have been granted exemption – they will be treated as if they had! “
